1. Agreement
By accessing or using Flowmint, the customer agrees to these Terms of Service and confirms that the person accepting them is authorised to act for the customer. If the customer does not agree, it must not use the service.
2. The service
Flowmint provides tools for hospitality operations, guest communications, automations, forms, bookings, and connected services. Features may depend on third-party platforms. We may improve or change the service while taking reasonable steps to avoid materially reducing paid functionality without notice.
3. Accounts and security
The customer is responsible for accurate account information, its FBID credentials, authorised team members, and activity under its account. Credentials must not be shared with unauthorised persons. The customer must notify Flowmint promptly of suspected unauthorised access.
4. Acceptable use
The customer must not use Flowmint to break the law; send unlawful, deceptive, abusive, or unsolicited communications; infringe another person's rights; upload malicious code; interfere with the service; bypass security or account limits; or attempt unauthorised access. The customer must follow the rules of connected channels, including WhatsApp and Meta policies, and obtain required messaging consent.
5. Customer data and privacy
The customer retains its rights in data it supplies to Flowmint and authorises Flowmint to process that data to provide, secure, support, and improve the service. The customer is responsible for the lawfulness, accuracy, and permitted use of its data. Our Privacy Policy explains our processing practices.
6. Third-party services
Connected services are provided by third parties under their own terms, availability, approvals, and charges. Flowmint is not responsible for a third party's suspension, outage, policy decision, or change, but will take reasonable steps to support the integration.
7. Fees and billing
Fees, billing frequency, unit counts, taxes, due dates, and any discounts are set out in the applicable quotation or order. Published calculator results are estimates until confirmed by Flowmint. Unless agreed otherwise, fees are payable by electronic funds transfer and are non-refundable for service already provided. Overdue accounts may be restricted or suspended after reasonable notice.
8. Intellectual property
Flowmint and its licensors retain all rights in the service, software, branding, and documentation. The customer receives a limited, non-exclusive, non-transferable right to use the service during its subscription for its internal business operations.
9. Availability and warranties
Flowmint will use reasonable care in providing the service. Except where the law does not permit exclusion, the service is provided without implied warranties and uninterrupted or error-free operation is not guaranteed.
10. Liability
Neither party is liable for indirect, incidental, special, or consequential loss to the extent permitted by law. Flowmint's aggregate liability arising from the service will not exceed the fees paid by the customer for the affected service during the six months preceding the event giving rise to the claim. This limitation does not apply where applicable law prohibits it.
11. Suspension and termination
Either party may end a month-to-month service on the notice stated in the applicable quotation. Annual commitments follow their agreed term. Flowmint may suspend or terminate access for material breach, unlawful use, security risk, or non-payment. On termination, the customer should export any information it needs before access ends. Deletion is handled under our retention practices and data deletion instructions.
12. Governing law
These terms are governed by the laws of the Republic of South Africa. The parties will first try in good faith to resolve a dispute directly before pursuing formal remedies.
13. Changes
We may update these terms and will give reasonable notice of material changes. Continued use after the effective date of updated terms constitutes acceptance where permitted by law.
